Privacy Notice
INTRODUCTION
Goodfellow Inc. (“Goodfellow” or the “Company”), recognizes the importance of protecting Personal Information (“P.I.“), i.e., any information about an individual that directly or indirectly identifies that individual.
This Privacy Notice (the “Notice“) describes the measures applied by Goodfellow to ensure the protection of the P.I. it collects, uses, discloses and retains in the course of operating its website and its ongoing operational activities.
The purpose of this Notice is to comply with the provisions of the Act Respecting the Protection of Personal Information in the Private Sector (“ARPPIPS”), as amended by S.Q. 2021, c.25, the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and the laws applicable in the other provinces of Canada.
COLLECTION OF PERSONAL INFORMATION
For the purposes of this Notice, the collection of P.I. by Goodfellow includes only that which is necessary for the purposes of its activities. This includes information relating to your identity, such as your surname, first name, address, telephone number and email address, as well as information relating to the use of the website, such as the number of visitors, the pages visited, etc.
Goodfellow collects P.I. in the following ways:
- Directly from you: Most of the P.I. that is collected is that which is provided directly from you when:
- you complete the “Send us a message” form via the “Contact Us” page of the website
- you complete the claim forms via the “You have a claim?” page of the website
- you communicate with someone at Goodfellow with questions or with specific requests relating to products and services.
- Through the Goodfellow website: Goodfellow may collect information relating to website visitors. This is done using “cookies”. Browsers may be configured to accept cookies automatically, but you may also configure them to request your approval before placing a cookie. These cookies allow us to personalize your visits (i.e. language) and recognize you when you return to our website (i.e. allows pages to load faster). By default, optional cookies such as analytics and performance have been disabled to respect user privacy. Where required by law, Goodfellow will obtain your consent before collecting information via cookies.
CONSENT
Goodfellow collects, uses and communicates P.I. for the purposes identified at the time of collection, such as when an individual fills out a Contact us or a Make a claim form via the website.
Examples of purposes for which Goodfellow collects P.I. include the following:
- Manage requests for products and services
- To confirm the identity of individuals
- To verify the accuracy of P.I. and update it as need be
- To manage and optimize the Goodfellow website
- Meet regulatory and legal obligations
By using the website, you consent to the collection, use and retention of the P.I. listed in this Notice.
ACCESS AND COMMUNICATIONS OF P.I.
P.I. is disclosed and accessible to Goodfellow employees who need to know the information to fulfill the purposes set out in this Notice. All P.I. held by Goodfellow is secure and accessible only to employees who have the right to access it in the course of their duties. The principle of least privilege is followed in granting access to P.I., depending on the role and responsibilities of the users.
Third parties (partners and suppliers) may also access the P.I. collected to fulfill the purposes set out in this Notice. They will not be able to access P.I. beyond what is reasonably necessary to fulfill the given purpose. Our service providers are contractually obligated to keep all information collected in the strictest confidence.
Goodfellow will not sell or share P.I. with other third parties except in the following cases:
- It is required by law;
- The disclosure of P.I. to a third party is required for a legal proceeding;
- The disclosure of P.I. to a third party is necessary to prove or protect legal rights;
- In the context of a commercial transaction, to potential buyers if the organization is to change hands; and
- To provide you with the services you requested or expect
RETENTION OF P.I.
The equipment used to store P.I. are located in Quebec, Canada. However, it is possible that the communication of P.I. to certain technology solution providers may result in the transfer of such information outside of Québec. In such cases, Goodfellow will first validate the requirements and practices applicable to the protection of P.I. in the relevant jurisdiction and take all reasonable measures to ensure that your P.I. is adequately protected.
Goodfellow shall put in place measures to ensure its compliance with the obligations to retain and dispose P.I.
Notwithstanding the foregoing, Goodfellow retains your P.I. when required to comply with applicable legal obligations.
SECURITY MEASURES
Goodfellow implements physical, organizational, contractual and technological security measures to adequately protect P.I. from theft, loss, unauthorized access, transfer, copying or alteration.
Goodfellow employees are bound by confidentiality agreements signed. Computer systems adhere to industry-recommended security frameworks and protocols.
RIGHTS OF WEBSITE USERS
As an individual whose P.I. has been collected by Goodfellow, you may exercise the following rights:
- Right to access, rectify or complete your P.I.: Goodfellow makes reasonable efforts to ensure that the P.I. it collects is accurate and complete for the purposes for which it is used. You may review your P.I., verify its accuracy, and request rectification, if necessary, subject to exceptions provided by law. Your request for access or rectification must be sent to the Chief Privacy Officer using the contact information below and will be processed no later than thirty (30) days from the date of receipt of your written request.
- Right to withdraw your consent: You may request to withdraw your consent for your P.I. to be used by Goodfellow for purposes that are not essential to the management and administration of its products and services. It will generally not be possible to withdraw your consent to the use of your P.I. for a purpose relating to the management and administration of products and services without terminating the business relationship. Any request to withdraw consent must be communicated to the Chief Privacy Officer whose contact information can be found below. Before we can provide you with any information, correct any inaccuracies or delete any information, we may ask you to confirm your identity and provide further details (in a secure manner) to help us respond to your request.
- Automated processing: Goodfellow does not carry out any decision-making process based exclusively on automated processing (without human intervention) of your P.I. Should Goodfellow implement a decision-making process based exclusively on automated processing (without human intervention) of P.I., you will be informed of the fact that you are the subject of such a process, of the decision that has been rendered and of your right to comment on this decision. You may also be informed of the following upon request:
- The P.I. used to reach this decision
- The reasons for the decision
- Your right to have the P.I. used to render the decision rectified
- Portability: You may, upon request, obtain a copy of the P.I. that has been collected about you. If the P.I. is computerized, you may request that it be provided to you in a structured, commonly used technological format.
- Right to file a complaint: Any questions regarding your P.I. or complaints regarding non-compliance with the principles set out in the Notice should be directed to the Chief Privacy Officer whose contact information are provided below.
NOTICE UPDATE AND AMENDMENTS
This Notice may be amended from time to time to maintain Goodfellow’s compliance with the law and to reflect any changes to the process for collecting P.I.
Any changes to this Notice will be subject to prior notice which will specify:
- The general purpose of changes to the Notice.
- The date on which these amendments come into force.
